Probation Period Salary, Leave and Benefits in India: What the Employer Owes a Probationer

November 04, 2026 · 7 min read

A new accounts manager at a Coimbatore pump manufacturer asks, in her second week, whether her PF will start now or after confirmation. The HR executive says after confirmation, because that is how it was done at her last company. Three months later the auditor finds eleven probationers with no PF deductions, and the owner learns that the habit was never the law.

During a probation period in India, an employee is paid the salary stated in the appointment letter, and the employer's statutory duties apply from the first day: PF and ESI where the establishment and wage are covered, leave as per state rules and company policy, and probation months counting towards continuous service for gratuity. The letter may hold back increments or certain perks until confirmation, but it cannot switch off what the law requires. Probation changes how secure the job is. It does not change what the employee is owed for the work done.

This page covers what a probationer is paid, PF and ESI, leave, gratuity, bonus and increments, and what the appointment letter should say so none of it becomes a dispute. The probation period pillar covers the rest of probation.

Is salary paid during probation

Yes, in full, as the appointment letter states. A probationer is an employee doing a real job, not a trainee on a stipend. A lower "probation salary" that rises on confirmation is lawful if the letter states both figures clearly and the lower one still meets the minimum wage for the role and state.

Since the Labour Codes came into force on 21 November 2025, the structure of the salary matters as much as the figure. Basic wage must be at least half of total remuneration, which affects PF, gratuity and bonus calculations from day one. A probation salary built mostly of allowances needs to be rebuilt. Confirm the exact split with your CA.

PF and ESI during probation

PF applies from the date of joining where the establishment is covered. Contribution is mandatory for employees whose basic wage is up to ₹15,000 a month and can be extended above that. There is no rule that PF begins at confirmation.

ESI applies from the date of joining for employees earning up to ₹21,000 gross a month in covered establishments.

The common mistake is an HR habit carried over from another company: "PF starts after confirmation." It produces arrears, interest and an uncomfortable conversation with the employee. If a company has been doing this, correct it now and pay the arrears.

Leave during probation

Leave accrues from the date of joining under most state Shops and Establishments rules, though many companies restrict when earned leave can be taken during probation. A restriction on availing leave is common and generally acceptable when written into policy. A rule that says probationers earn no leave at all usually is not.

Three things to write down in policy:

  • What accrues. Earned leave, casual leave and sick leave, each at the rate the state rules set or better.
  • What can be taken. For example, casual and sick leave from day one, earned leave after confirmation.
  • What happens to unused leave if the person leaves during probation: encashed in the final settlement as the rules require.

Gratuity, bonus and increments

Gratuity. Probation counts as continuous service. A person confirmed after six months has six months of gratuity-eligible service already, not zero. Under the Labour Codes, fixed-term employees become eligible after one year of continuous service.

Statutory bonus. Eligibility depends on days worked in the year and the wage ceiling, not on confirmation status.

Increments. Holding the first increment until confirmation, or until the next annual cycle after confirmation, is a company decision. Most disputes here come from a promise made verbally at the offer stage. The offer letter and appointment letter spokes cover how to write it so nobody remembers it differently.

What the law sets and what your letter sets

Most confusion about probation pay disappears once an owner separates the two layers.

Two columns comparing what the law sets during probation, minimum wage, basic wage at least 50%, PF and ESI from joining, leave accrual, continuous service and statutory bonus, with what the appointment letter sets, the salary figure, the first increment, perks at confirmation, when leave can be taken and the notice during probation
The law sets the floor. The letter sets everything above it.
  • The law sets: minimum wage, the basic wage share, PF and ESI from joining where covered, leave accrual, continuous service, statutory bonus.
  • The letter sets: the salary figure during and after probation, when the first increment comes, which perks start at confirmation, when earned leave can be availed, and the notice period during probation.

Anything in the second list that is not written down will be argued about in month six.

Perks that can reasonably wait for confirmation

Some benefits are company choices, not statutory duties, and holding them until confirmation is common practice.

  • Group health insurance top-ups beyond any statutory cover.
  • Variable pay or incentive plans tied to a full cycle.
  • Loans, salary advances and car or phone schemes.
  • ESOP eligibility, where it exists.

The rule is the same for all of them: state in the letter that the benefit begins on confirmation, so the person can decide with full information before joining.

If the person leaves during probation

When employment ends during probation, the final settlement includes salary for days worked, notice pay where applicable, encashment of accrued leave as the rules require, and PF transfer support. Withholding any of it because the person "did not complete probation" is a common error. Completion of probation decides security, not entitlement. The notice period during probation spoke covers the exit itself.

Pay is not the probation question

Owners spend more time on what to pay during probation than on what to look for during it. The salary is settled on day one. The real question of probation, whether this person fits this role in this company, is open until day ninety, and it gets answered by default if nobody asks it.

The probation period pillar gives four checkpoints that turn the months into a decision, and the KRA meaning spoke shows how to set what will be judged. The Business Pulse reads how your organisation actually runs, where decisions form and where they stall, which is the context a probation decision is made in.

Questions people ask about probation period salary

Is salary paid during the probation period?

Yes. A probationer is an employee and is paid the salary stated in the appointment letter for every day worked. A lower probation salary that rises on confirmation is lawful only if the letter states both figures and the lower one still meets the applicable minimum wage for the role and state.

Is PF deducted during probation?

Yes, where the establishment is covered. PF applies from the date of joining, and contribution is mandatory for employees whose basic wage is up to ₹15,000 a month. There is no rule that PF starts after confirmation; companies that delay it owe arrears with interest.

Can an employee take leave during probation?

Leave usually accrues from the date of joining under state rules, but many companies restrict when earned leave can be availed until confirmation. Casual and sick leave are commonly allowed from day one. The policy should state what accrues, what can be taken and what is paid out on exit.

Does probation count for gratuity?

Yes. Probation months count as continuous service, so a confirmed employee's gratuity-eligible service starts from the date of joining, not the date of confirmation. Under the Labour Codes, fixed-term employees become eligible for gratuity after one year of continuous service.

Is an increment given after probation?

Only if the company chooses and the appointment letter says so. Some companies give an increment on confirmation, others wait for the annual cycle. Whatever the practice, write it into the offer and appointment letters, because verbal promises made at hiring are the most common source of probation pay disputes.

Can a company pay less during probation?

Yes, if the appointment letter states a probation salary and a post-confirmation salary, and the probation figure meets the minimum wage and the basic-wage rules. The difference should be explained at the offer stage so the candidate accepts it knowingly, not discovered on the first payslip.
